The farm bill states that all products and byproduct from the production of hemp and CBD plants are legal as long as the delta 9 percentage is under 0.3%.
Since delta 8 is not delta 9, the percentages of delta 8 do not fall under this stipulation giving the space for delta 8 to be legal federally.
