Cannabis sativa is the species of plant producing both hemp and marijuana. The species may be the same, but the cultivars are different.  A cultivar is a cultivated variety to produce a certain plant with specific characteristics. Hemp has one cultivar to produce a plant with specific differences than the marijuana plant. Marijuana is genetically different than hemp, but they are both forms of cannabis.

Hemp Industry Regulations — Two Cannabis Cultivars

Marijuana is a cultivated plant used either for medicinal purposes or recreational purposes but is still a psychotropic drug.  Hemp is cultivated for use in the production of a wide range of products with therapeutic benefits for anxiety, depression, obesity and chronic pain. The hemp industry regulations require a distinction for each of the products because they have separate statutory definitions in federal law.

Controlled Substances Act

Hemp and marijuana have clear definitions. Even so, the industry regulation has restricted the use of hemp along with marijuana until recently.  Hemp’s association with marijuana automatically made its growth, production and use illegal under U.S. drug laws. In the late 1950s, hemp was placed under Schedule I controlled substances of the Controlled Substances Act (CSA). The U.S. Drug Enforcement Administration (DEA) also holds strict regulations for production of hemp.

Hemp Industry Regulations — The 2018 Farm Bill

In 2018, things started to change with the 2018 Farm Bill.  This bill directed the USDA to establish a national regulatory framework for hemp production in the United States.  The U.S. Domestic Hemp Production Program resulted from this directive with provisions for domestic production of hemp following hemp industry regulations.

Hemp Legalization

Hemp was legalized under federal law. Most states followed and adopted federal hemp industry regulations.  A few states opted out of the federal regulations and adopted laws still banning hemp. With the legalization of the production of hemp as an agricultural commodity it was also removed from the list of controlled substances.  Part of this legalization with the 2018 Farm Bill, industrial hemp is defined as Cannabis sativa L.  It is required to have a THC threshold of 0.3%.  States still retained the right to not be part of the 2018 Farm Bill and disallow hemp production.  The farm bill also included within its laws for Idaho, Mississippi, New Hampshire \’\’and South Dakota to continue to ban production of the crop within their borders.

Considering Licensing

For a farmer to legally produce hemp, the USDA provides a license to them under a specific state or tribe.  An individual state or Indian tribe has the right to request primary regulatory authority over the production of the hemp crop within their borders. To become the primary regulatory authority the state or tribe must submit a plan to monitor or to regulate the hemp crop growing right.

Hemp Industry Regulations — Understanding Interstate Commerce Regulations

Since there are still four states which have not legalized the growing of hemp as a crop, there have been discrepancies as to if a vehicle is transporting a crop of hemp through a state where it is not legalized.  The 2018 Farm Bill clarifies that a state or Indian tribe may not restrict the transportation throughout its borders. This regulation provides access to the farmers of nationwide markets.
