The Georgia Department of Agriculture (GDA) confirms the legality of the hemp plant for commercial purposes in cultivation \’\’and sale. And hemp flower in Georgia legal \’\’and for sale is good news to Georgians. In Georgia, the law goes a step further in clarifying what they have legalized regarding the hemp flower products. It permits selling of hemp products with 0.3% THC levels or less to include all hemp products derived from, or made by, processing hemp plants or plant parts.


This does not include, however, the making of food products infused with CBD or THC hemp for sale in restaurants, unless they are approved by the United States Food \’\’and Drug Administration. Since the hemp plant is legal \’\’and agriculture is growing but slower than other states because of the stringent licensing rules \’\’and regulations \’\’and the high costs of each acre planted.

In February 2019, Georgia lawmakers proposed legislation allowing the planting \’\’and growing of the hemp plant \’\’and processing of the hemp flower in the state, but the public was unhappy with it because of high licensing fees for the hemp farmers. The Georgia regulations were some of the most restrictive in the nation, but Governor Kemp still signed the bill into law in May 2019.


The cultivation of hemp flower in Georgia has some challenges because of their strict regulations. Processors who are interested in working with hemp are burdened with a $25,000 annual licensing fee \’\’and the hemp farmer pay $50 per acre of l\’\’and. Georgia, unfortunately, sets up contracts \’\’and limits for the growers \’\’and processors regarding the transfer of goods.


All licensed hemp growers are required to submit an annual report no later than November 30 for the acres the farmer is planning on planting \’\’and submit it to Georgia Department of Agriculture.

Even from Georgia, the CBD \’\’and hemp extract products are projected to reach $24 billion by 2023.  In 2020 Georgia planted its first legal hemp plant crop since the signing of the 2018 Farm Bill.  Acreage is generally low at about 400 acres planted by 80 farmers granted licenses in the 2020 season.
