Who oversees the rules and regs of hemp growing in states?

The state Department of Agriculture is the entity that sets rules, oversees license issuing and testing for hemp crops.


Tour of Hemp in States –North Carolina

The Agricultural Act of 2014 gave authorization to certain research institutions and state departments of agriculture to grow industrial hemp. CBD hemp in North Carolina had a head start with a pilot program to grow hemp as experimentation under the supervision of the state and a state institution such as a state university.  North Carolina continues to operate under the Industrial Hemp Pilot Program authorized in 2014.


2018 Farm Bill changed many things for farmers as they were given the opportunity to grow, not only a financially profitable crop but one that had so many environmental and health benefits.


Many farmers focused on producing smokable hemp buds, even though at the time there was a tentative ban pending in the state Legislature.  CBD hemp in North Carolina is grown by previous tobacco farmers because they had the infrastructure and labor in place for producing smokable hemp flower.  In 2019, North Carolina licensed:


  • 933 hemp farmers;
  • 11,572 outdoor hemp acres;
  • 4.5 million square feet of indoor hemp cultivation.

You might think that a state which has legalized marijuana on all levels of growing, using and smoking, that they would be on the cutting edge of hemp. But the situation continues to be complicated in California.  On the federal level, hemp is legal since the 2018 Farm Bill, but California issued strict laws regarding the use of hemp in all forms including CBD.  The state continues to ban selling CBD in food products unless it is CBD from cannabis marijuana. There is some CBD in marijuana, but very little making the CBD products extremely expensive.


That takes it to the other area of non-food products such as vape pens, hemp pre-rolls and also the CBD hemp flower nugs. Well, according to the California Department of Public Health, California law says there are no “thou shalt nots” in regard to the manufacturing, processing or selling non-food hemp.  Tour of hemp in states shows that hemp flowers also are in a legal gray area in the Golden State meaning that hemp flower is not entirely illegal but it does remain unregulated.  Then in October 2019, Governor Gavin Newsom signed Senate Bill 153 that changes previous hemp cultivation laws giving them a green light compliance with the 2018 Farm Bill.  This law took effect January 1, 2020.


Currently the California Department of Food and Agriculture (CDFA) has 23 counties producing hemp, 258 growers, 34 seed breeders along with 16,899 registered acres.  Many in agriculture anticipate that there will soon be a powerhouse of hemp production. California has the soil and the temperate climate which allows for year-round cultivation. This means that more than one crop can grow to maturity in a 12-month period.

If you live in Pennsylvania, you can fill out the Pennsylvania Hemp Permit Application found on the PDA website at The deadline for application submission is April 1 of whatever year you are wanting to plant your hemp crop. There are no limits to the number of permits to grow hemp and no limit to the number of acres which the hemp farmer wants to plant.  There were 324 permit holders who planted and grew approximately 4,000 acres of hemp in 2019. This was the third year that hemp had been grown in Pennsylvania after having been banned for almost 80 years. PDA has a permit application fee along with other fees such as ones in relation to official sampling and THC testing.


Tour of hemp in states reveals that the application must meet certain criteria in order to be approved. There is no limit to the size of plantings, however, for each deeded property, the hemp farmer will need a separate permit. The cost of the permit was lowered in 2020 to $150.  The permit applications must be filled out each year by April 1 as there are changes year by year. Permits expire on December 31st of each year; however, the 2020 application form was extended through February 2020. And as stated before, if you have multiple properties on which you will plant hemp, it is necessary to have a separate application or permit.  The requirements for the licenses and permits in Pennsylvania to change perhaps even yearly.

It is a good idea to know the rules and regulations from state to state so as to protect yourself. And laws are changing as well so it is advantageous to check frequent about updates from your state. Always know you are federal legal but states vary.
